User Agreement

These terms and conditions apply to all purchases made from The Backyard Boutique.

Orders and Delivery

All orders placed through this website are subject to confirmation and acceptance by The Backyard Boutique. The Backyard Boutique's selected courier company will deliver the goods you order to the address you specify either in your online account that you hold with The  Backyard Boutique or at the time of your order. Your order will be processed and delivered within the agreed timeframe subject to availability of goods ordered. Where these goods are not available you will be notified of this by The Backyard Boutique as soon as possible. Anyone at the delivery address who receives the goods will be presumed by The Backyard Boutique to be authorised to receive the goods. If it is not possible at the nominated address to receive the goods, Australia Post will leave a card advising you where you can pick your parcel up from. Once the goods are delivered to you, you will own them and it is your responsibility if they are lost or damaged.  If you elect to have the goods left without a signature upon delivery then once delivered, you will own them and it is your responsibility if they are lost or damaged. Some orders incur a freight and handling fee. We reserve the right to select and/or vary our freight carrier and freight charges. 

Delivery Point Information

You agree to provide all relevant details regarding access to the delivery point such as whether there are stairs, elevators, steep driveway and you acknowledge that we will not be held responsible if those details are incomplete or inaccurate.

Prices and Payment

For each order you must pay both the applicable price for the relevant goods and the freight and handling fee specified on the website at the time. Credit information is secure as we use Paypal for all transactions online. We take great care to ensure that our pricing is accurate and current. We reserve the right to alter and update our pricing and delivery charges at anytime. If we need to order an item in for you, the price shown may no longer be current as new stock shipments may have different prices. We will inform you of the new price and seek your instructions before proceeding.

Coupon Codes

The Backyard Boutique website only permits the use of one coupon code per transaction. Discounts and special offers issued through coupon codes are able to be used on items already marked down unless otherwise stated. Coupon codes, however, are not able to be used in conjunction with one another. Coupon codes offering discounts are not able to be used when purchasing or redeeming gift certificates or placing an order at a Backyard Boutique party plan event.

Refund and Exchanges

If for any reason you are not satisfied with your purchase from The Backyard Boutique or the product is faulty or damaged, then you may return the item(s) to us within 10 days from date of delivery for a replacement or refund, provided the items(s) are returned in original condition including its packaging and an explanation is given with a copy of the original tax invoice/proof of purchase. If upon delivery to you your item is damaged or defective we will arrange for a replacement to be sent to you. In this event, notification must be provided to The Backyard Boutique within 48 hours of your parcel being signed for. All items are subject to inspection prior to crediting a refund or arranging a replacement product. However if you simply change your mind, make an incorrect choice or are not happy with your purchase the item(s) are returned to us at the customer’s own cost and risk. Once received back we will refund in full the purchase price of the goods (excluding delivery charges).

Sales

Like most retailers, we have sales or specials on some or all of our products from time to time.   If you have purchased a product from us at full price and we later have that same product on sale or special, we cannot give you a discount for your purchase.  The sale price or discount is only available for those products purchased during the period of the sale or special.

Your Account

You agree to take responsibility for the safekeeping of your username and password. You are liable if your username and password is used by an unauthorised person. You agree to release and indemnify The Backyard Boutique in connection with any use (whether authorised or unauthorised) of your username and password. The Backyard Boutique may suspend or cancel your account at any time without prior notice.

Images

The Backyard Boutique endevours to include up-to-date pictures of all the goods on this website. However, our images of the goods may differ from the actual goods. We recommend that you carefully read the descriptions of the goods prior to purchase and that you read the labels on the goods prior to using them.

Privacy

The Backyard Boutique will comply with our privacy statement.

Liability

We do not have any liability to you arising from the supply of products except that we shall provide you with a refund or replace products if there are any defects. All other warranties and representations are excluded to the extent permitted at law. Our liability for any claim related to the supply of goods by us is limited to the cost paid by you for the purchase of those goods except where otherwise provided by law. To the extent permitted by law you release us from all other liabilities whether in contract, tort or otherwise for any loss, damage, expense of any kind arising directly or indirectly out of the supply of the goods. 

Changes to Terms and Conditions

Each order is governed by the Terms and Conditions current when the order is placed. The Backyard Boutique may add to, delete or otherwise change these terms and conditions without prior notice. It is your responsibility to read and understand these terms and conditions each time you place an order.
